An Internet Lawyer required before setting up internet businesses?
I wonder if most Internet Marketeers (IM) we see on the web today are sufficiently safe-guarded legally and if they seek internet lawyers to make all necessary legal provisions for their businesses before they publicly launch. If so, it will be very costly to start up an internet business – what do most IM do?
There’re areas which I think would require addressing which is currently not clear as to what legal safeguards are to be put in place for the internet marketeer. This question is not to “run away” from responsibilities but just like you would require the legal framework to be put in place when running a physical offline business. In other words, you run a legitimate Internet business but do not want to fall prey in certain legal omissions due to ignorance.
Some reference areas to address below:
a. Affiliate marketing
b. Email marketing
c. PLRs, Master Resller Rights, etc
d. General Internet Business coverage
e. Incorporation of a private limited company
Most corporate attorneys work with small businesses on a sliding scale. For an initial retainer, they provide some basic incorporation services, some general advice on startup questions, and perhaps review or preparation of key legal documents like purchase orders, sales orders, and invoices. In a similar way, a startup business owner has out of pocket expenses for engaging a CPA to set up his accounting and taxes, usually again done on a sliding scale.
Attorneys and CPAs understand that the startup phase is expensive for a small business, and their interest is in developing long term relationships with successful businesses, who will give them work over a long period, and introduce them to other business clients. So, the idea is generally to start small, restricting your activities to a reasonable geographic area, as the business launches. This limits the scope of your legal and accounting issues, at the same time the natural growth of the business provides revenues, and further issues that require the expertise of the attorney and the CPA.
Nobody launches a global business in a day, unless they already have a global business with which they can support the new venture.
